Acceptable Use

Overview

This Acceptable Use Policy (“AUP”) sets the rules for using SprukoMarket, operated by Spruko Technologies Private Limited (“Spruko”, “we”, “us”). This policy applies globally to all users of the SprukoMarket platform, including Authors and Buyers, and forms part of the Terms of Service. If anything in this policy conflicts with the Terms, the Terms will control.

1. Scope & Responsibility

• This AUP covers your use of the site, accounts, listings, previews, downloads, messaging, reviews, support channels, APIs/keys, and any Spruko-managed demos or hosted environments.
• Authors are responsible for the legality, safety, security, and accuracy of their Items and listings.
• Buyers must use Items within the purchased license. See Licenses.
• Age: You must be at least 18 years old to register. Where permitted by law, users aged 13–17 may access the Service only with verifiable parental or guardian consent.

2. Prohibited Content & Activities

You agree not to, and not to help others to:

• CSAM / sexual exploitation: Zero tolerance for child sexual abuse material, sexualization of minors, or content that facilitates exploitation; we report to authorities.
• Illegal / rights-infringing: Piracy; unauthorized third-party assets; trademark/copyright violations; invasion of privacy; unlawful surveillance or doxxing.
• Deceptive deepfakes, synthetic media & impersonation: No synthetic media that materially misleads about a person’s identity, voice, or actions without clear labeling and a lawful basis.
• Harmful code / security abuse: Malware, spyware, backdoors, credential harvesters; attempts to bypass access controls, license checks, or DRM.
• Fraud / deception: False identity or affiliation; review/rating manipulation; payment fraud; refund/chargeback abuse; steering Spruko-originated deals off-platform to evade fees or buyer protections.
• Abusive conduct: Threats, harassment, or content that promotes violence or hate against protected classes; extremist or terrorist material.
• Sanctions / export: Use by or for entities/individuals on UN/EU/US/UK sanctions lists, in embargoed regions, or for prohibited end uses is not allowed.
• Personal & sensitive data misuse: Collecting or processing personal data (including children’s data or sensitive categories like health/biometrics) without a lawful basis, required notices/consents, or in violation of our Privacy Policy or applicable law.

3. Technical & Usage Restrictions

• Scraping & mass downloads: No bots, scripts, or automation to mirror libraries, harvest previews/Items, or bypass anti-abuse systems. Good-faith search-engine indexing that respects robots.txt is permitted.
• Rate limits & geo rules: Respect technical limits (downloads, bandwidth, API calls). Limits may adjust dynamically. Do not use VPNs, proxies, or spoofing to evade limits or geography-based requirements.
• Previews & watermarks: Do not remove or alter watermarks or metadata; previews/free files are for evaluation unless a license expressly permits broader use.
• APIs & keys: Keep keys secret; do not embed them in public code; use only documented endpoints; no scraping via API.

4. Author Content Standards

• Rights & disclosures: Hold all necessary rights. Disclose third-party/open-source components and include required notices; ensure license compatibility. Third-party components remain subject to their own licenses in addition to these terms.
• Security & quality: No malicious code, hidden telemetry, or undisclosed data collection. Provide accurate descriptions, dependencies, compatibility, and clear support scope/timeframes if marked “Supported”.
• AI-generated or AI-modified content: Disclose AI-generated/materially AI-modified portions; warrant lawful training sources and compliant outputs (no personal data without a lawful basis). Review outputs to avoid rights violations.

5. Buyer Use of Items

• License scope: Use Items only as permitted by the selected Spruko License (seat/domain/end-product limits; no redistribution beyond license). See Licenses.
• Seats & team size: “Team size” means the number of individuals who may access the Product’s source files to build End Products.
• End Products: Create a new End Product of your own; do not resell Items “as-is” or create packs that substitute for the Item itself.
• On-demand & competing libraries: Follow Section 3 / 3.1. Unless your license expressly allows it, no on-demand generators, app/site/logo makers, multi-tenant SaaS, or competing libraries.
• No source exposure: Do not include the Item’s raw source files in membership libraries, bundles, or downloads that expose source.
• Trademarks & branding: No rights are granted to use Authors’ or Spruko’s names, logos, or trademarks, except where attribution is expressly required by the Item page or component license.
• Attribution: Not required unless the Item page, license, or a third-party component specifically requires it; if required, include the stated attribution/notice.

6. AI Tools (if available)

• Outputs from AI tools may be inaccurate or unsuitable. You are responsible for evaluating outputs and ensuring rights/compliance before use.
• We may use third-party AI providers; their terms may apply. We do not guarantee exclusivity or non-infringement for AI outputs.
• Do not use AI tools for automated decisions with legal or similarly significant effects on a person (e.g., employment, credit, healthcare) without a lawful basis and required notices/consents.

7. Security Testing (Safe Harbor)

We authorize good-faith, non-destructive testing of public demos and previews to help improve security. Follow these rules:

• No access to customer data; no lateral movement; no service disruption or data exfiltration.
• No DDoS/volumetric attacks and no social engineering of Spruko staff or vendors.
• No attempts to access non-public data or environments.
• Stop immediately if you encounter personal data and report responsibly.
• Report suspected vulnerabilities via: [email protected] or Submit a request. Include enough detail to reproduce. Bounties, if any, are governed by our program terms and are not guaranteed.

If you comply with this Section, we won’t pursue legal action for the reported activity. Coordinated disclosure timelines may apply.

8. Moderation & Enforcement

• We may remove content, restrict features, place holds, or suspend/terminate accounts where we reasonably believe this AUP, the Terms, or law are breached.
• Serious violations (e.g., malware, CSAM, trafficking in stolen IP) may be reported to authorities and affected rights holders.
• We may use technical controls (e.g., throttling, IP/device checks, re-verification) to protect users, rights holders, and the platform.
• Payout holds: We may hold or reverse author payouts linked to fraud, abuse, unresolved chargebacks, or suspected violations while we investigate.
• Appeals: If action is taken under this AUP, you may appeal via our Submit a request with relevant context; we will review within a reasonable time.

10. Updates to this AUP

We may update this AUP from time to time. Material adverse changes will be reasonably noticed (e.g., banner or email) before they take effect. The “Effective date” above shows when this version started.

11. Legal

• This AUP is incorporated into and governed by the Terms of Service (including governing law and venue).
• If any part of this AUP is unenforceable, the remainder remains in effect.

12. Regional Terms

• India: See the Grievance Officer details above. We acknowledge qualifying grievances within 24 hours and endeavor to resolve within 15 days, as required by applicable law.
• Sanctions / restricted territories: The Service is unavailable where prohibited by law or sanctions, including to persons on UN/EU/US/UK lists.
